1. Service overview

Video Upscaler lets you upload videos and request AI-powered upscaling and enhancement. Processing is performed by third-party inference providers. Outputs are delivered back to your storage within the Service.

2. Eligibility and accounts

• You must be at least 16 years old to use the Service.
• You are responsible for maintaining the security of your account and for all activity under it.

3. Acceptable use

• No illegal content or activity.
• No adult or sexually explicit content.
• No content that infringes intellectual property or privacy rights.
• No malware, abusive behavior, or interference with the Service.

4. Your content

• You retain ownership of content you upload.
• You grant us a limited, non-exclusive, revocable license to host, store, process, transmit, and display your content solely to provide the Service you request.
• We do not train models on your uploads. We do not use your content to develop or improve models beyond operating the Service.
• You represent that you have all necessary rights to upload the content and to grant the license above.
• File retention: All uploaded and output files are automatically deleted 24 hours after creation. You must download your files before they expire. We are not responsible for files that are not downloaded in time.

5. Payments, balances, and refunds

• Payments are processed by Polar. We do not store full payment instrument details on our servers.
• Upscaling is billed per minute of video. We round up to the next minute (minimum 1 minute). You are charged from your prepaid balance accordingly.
• Refunds: Refunds for unused balances are available on request, no questions asked. Contact [email protected].
• Taxes: Prices may exclude taxes; you are responsible for any applicable taxes.

6. Third-party services

We rely on third parties to operate the Service, including Cloudflare R2 (US) for storage, RunPod for AI inference, Polar for payments, Postmark for email, PostHog for analytics, and DigitalOcean for hosting. Your use of the Service constitutes consent to processing by these providers as necessary to deliver the Service.

7. Termination

• You may stop using the Service at any time.
• We may suspend or terminate access for violations of these Terms or to protect the Service, users, or third parties.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL POZY DEV LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Governing law and venue

These Terms are governed by the laws of Kenya, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Nairobi, Kenya.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and modify the effective date. Material changes may be communicated via the Service or email.
